These Terms & Conditions (“Terms”) govern the website subscription service provided by [LEGAL ENTITY NAME] (“the Agency”, “we”, “us”, “our”) to the customer (“you”, “the Client”). By checking the acceptance box and submitting your order, you confirm that you have read, understood, and agreed to these Terms.
1. Scope of Service
We provide a complete website service that includes:
Custom website design built on WordPress using our own premium templates and block library;
Professional managed hosting;
SSL security; and
Ongoing technical maintenance.
The base subscription includes a website of up to five (5) pages. Additional pages are available at $[X] per page (one-time build fee) or under a higher subscription tier. E-commerce, booking systems, multi-language setups, and similar advanced functionality are quoted separately.
2. Content & Materials
You are responsible for providing all text, images, logos, and branding materials for your website.
The base plan includes the use of professional stock photography and AI-generated placeholder text where you do not supply your own. We do not source, license, shoot, or create custom photography or illustrations as part of the base fee; any such work is quoted and billed separately.
If you do not provide your materials within fourteen (14) days of order confirmation, we will launch your website using high-quality stock photography and AI-generated placeholder content. The monthly fee remains due regardless of whether you have supplied your custom content.
3. Minimum Term
By submitting your order, you agree to a minimum term of twelve (12) months starting from the launch date. Early termination before the end of this term requires payment of the remaining monthly fees for the contract period.
4. Fees & Billing
The subscription fee is $99 per month, billed automatically each month. The subscription and billing begin immediately upon order confirmation. Payments not received within seven (7) days of the due date may result in temporary suspension of the website until the account is brought current.
5. 14-Day Satisfaction Guarantee
If you are not satisfied with the initial design concept, you may request a refund of your first month’s fee within fourteen (14) days of order confirmation.
This guarantee covers the design fee only and excludes any third-party or hard costs already incurred on your behalf — including, without limitation, domain registration, premium plugin or template licenses, and stock media. Such costs are non-refundable and will be deducted from any refund issued.
Domain registration is carried out only after the 14-day period ends, unless you request earlier registration in writing — in which case the domain cost becomes immediately non-refundable.
6. Ownership & License
Your content and custom design. The text, images, and branding you supply remain yours. After twelve (12) consecutive monthly payments are completed, you are entitled to receive a full backup (export) of your website files and your custom page layouts so that you may host the site elsewhere.
Premium third-party licenses are not included and do not transfer. The website is built using premium third-party themes, page-builder components, and plugins that are licensed exclusively to the Agency. These licenses are non-transferable, remain the sole property of the Agency, and are not included in any backup, export, or handover.
If you move your website off our hosting, continued use of any premium-licensed components and their features will require you to purchase your own license directly from the relevant provider. Without a valid license of your own, certain design elements, blocks, or features may be limited, disabled, or stop receiving updates. The Agency is not responsible for functionality that depends on a license you do not separately hold.
7. Maintenance & Support
Monthly maintenance includes:
Core and plugin updates;
Security monitoring;
Regular backups; and
Up to two (2) hours of content edits per month (text changes, image replacements, adding new blog posts).
Unused hours do not roll over to the following month. Major redesigns, new features, and additional pages are quoted and billed separately.
8. Hosting & End of Subscription
Your website is hosted on infrastructure managed by the Agency and remains live only while your subscription is active. After the 12-month minimum term, the subscription continues on a month-to-month basis until cancelled with at least [30] days’ written notice.
If the subscription ends or is cancelled, hosting is discontinued and the website is taken offline. You may take your backup (per Section 6) and host the site elsewhere at your own arrangement.
9. Suspension & Termination
We may suspend or terminate the service for non-payment, breach of these Terms, or unlawful use. Suspension for non-payment does not relieve you of fees due for the minimum term.
10. Limitation of Liability & Governing Law
